Terms of Use

The short version: our apps and this website are provided as-is, free of charge, and at your own discretion. They're made with care, but they come with no warranties, they're not professional advice, and our liability is limited to the fullest extent the law allows.

1. Agreement

These Terms of Use ("Terms") apply to the Posaria website (posaria.ai) and every app we publish (together, the "Services"). By downloading, installing, or using any of the Services, you agree to these Terms. If you do not agree, please do not use the Services.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use our apps for your own personal, non-commercial use on devices you own or control. Apps downloaded from the Apple App Store or Google Play are also governed by that store's own terms, including Apple's standard Licensed Application End User License Agreement where applicable.

3. Not professional advice

Our apps are for general informational and recreational purposes only. They are not medical, health, financial, legal, or travel advice, and they are not a substitute for the judgment of a qualified professional.

Health & wellness features (for example, breathing exercises in Exhale) are intended for general relaxation. They are not medical advice, diagnosis, or treatment, and no Posaria app is a medical device. Stop immediately if you feel dizzy, short of breath, or unwell, and consult a physician before using breathing exercises if you are pregnant or have any respiratory, cardiac, or other medical condition. Never disregard professional medical advice because of something in our apps.
Travel-related content (destinations, itineraries, routes, opening hours, conditions) may be incomplete, inaccurate, or out of date. Verify independently before you rely on it. You are solely responsible for your own safety, belongings, and compliance with local laws when you travel.

4. Third-party vendors and offers

Some of our apps may display offers, deals, advertisements, or content from third-party vendors (for example, destination-based offers in travel apps). We do not own, operate, endorse, or control those vendors. We make no representations or warranties about their goods, services, pricing, availability, or conduct. Any purchase, booking, or other transaction you enter into with a vendor is solely between you and that vendor, and any dispute arising from it must be resolved with the vendor directly.

5. Acceptable use

You agree not to misuse the Services — including attempting to disrupt them, accessing them by automated means for scraping or abuse, reverse engineering except where the law expressly permits it, or using them for anything unlawful.

6. Intellectual property

The Services — including all software, designs, artwork, text, and branding — are owned by Posaria or its licensors and are protected by intellectual-property laws. Except for the limited license above, no rights are granted to you.

7. Disclaimer of warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY INFORMATION IN THEM IS ACCURATE, COMPLETE, OR CURRENT.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POSARIA AND ITS OWNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

9. Indemnification

You agree to indemnify and hold harmless Posaria and its owner from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Services or your violation of these Terms.

10. Changes

We may update, change, or discontinue any part of the Services at any time. We may also revise these Terms; the current version, with its effective date, will always live at this page. Continuing to use the Services after a change means you accept the revised Terms.

11. Governing law

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules, and any dispute shall be brought exclusively in the state or federal courts located in Texas.

12. Miscellany

If any provision of these Terms is held unenforceable, the rest remain in full effect. These Terms, together with our Privacy Policy, are the entire agreement between you and Posaria regarding the Services.
